Part 1 — Website Terms of Use
1. Website Purpose Only

Use of this website does not create a contract for roofing work, repair work, replacement work, inspection services, emergency services, consulting services, warranty services, or any other service. No contract for work exists unless Rainbow Roofing separately approves the project and the parties enter into a written agreement signed or otherwise accepted by Rainbow Roofing.
2. No Professional Advice
Nothing on this website is legal advice, engineering advice, architectural advice, tax advice, insurance advice, public adjusting advice, code compliance certification, or a guarantee of permit approval, insurance coverage, or construction outcome.
Any information about roof condition, storm damage, leaks, life expectancy, repair options, insurance claims, code issues, or products is general information only unless expressly stated in a separate written agreement signed by Rainbow Roofing.
3. No Guarantee of Service Availability
Rainbow Roofing may limit, refuse, postpone, or cancel service, estimates, inspections, scheduling, website access, or communications at any time and for any lawful reason, including location, weather, safety concerns, staffing, material shortages, project type, customer conduct, prior account history, inability to access the property, or lack of contractor availability.
Website availability in your browser does not mean services are available at your property.
4. Estimates, Quotes, Inspections, and Proposals Are Preliminary
Any estimate, quote, proposal, measurement, inspection summary, recommendation, scope description, timeline, or price shown on the website or communicated by phone, email, text, chat, or in person before execution of a final written agreement is preliminary only.
All such information is subject to change because of: hidden damage, deck or structural issues, moisture intrusion, mold, code requirements, permit requirements, safety issues, product availability, supplier pricing, weather, measurement revisions, access limitations, insurance scope changes, municipal requirements, site conditions, or errors in the information provided to us.
Rainbow Roofing may revise scope, materials, methods, pricing, timeline, and recommendations before or after inspection and before a final written contract is executed.
5. Hidden Conditions
Roofing and exterior work can expose hidden, latent, unknown, or concealed conditions, including structural defects, rot, mold, moisture intrusion, electrical hazards, code violations, improper prior work, unsafe decking, ventilation problems, pest damage, and hazardous materials.
Rainbow Roofing is not responsible for identifying every hidden condition during a website inquiry, remote estimate, satellite review, photo review, preliminary inspection, or limited site visit. Discovery of hidden conditions may require additional work, change orders, additional charges, different materials, specialty contractors, project delay, or project cancellation.
6. Weather, Safety, and Delay Disclaimer
Roofing work is weather-dependent and safety-sensitive. Rainbow Roofing may delay, reschedule, suspend, or refuse work, inspections, temporary dry-in, or other services due to rain, wind, lightning, heat, unsafe access, active hazards, site conditions, labor shortages, supplier delays, permit delays, municipal inspections, force majeure events, or any other condition affecting safety, legality, or performance.
All timeframes and scheduling statements are estimates only unless specifically guaranteed in a separate signed writing.
7. Product and Color Variations
Website photos, descriptions, samples, colors, renderings, and product references are illustrative only. Actual materials may vary in appearance, shade, texture, lot consistency, dimensions, and availability.
Rainbow Roofing reserves the right to substitute comparable materials, methods, or components where necessary, subject to any separate written agreement.
8. No Insurance Claim Guarantee
Any statement on this website regarding storm damage, insurance restoration, claim support, claim documentation, or claim-related services is general information only. Rainbow Roofing does not guarantee that any insurance company will approve a claim, pay a certain amount, accept a coverage position, or issue payment within any timeframe.
You remain responsible for your own policy, deductible, claim communications, and coverage decisions unless otherwise stated in a separate written agreement.
9. User Representations
By using the website or submitting information, you represent that: you are at least 18 years old; you have authority to submit the information; the information you provide is accurate and complete; if you request a property visit, you have authority to grant access; you will not use the site for fraud, harassment, abuse, or unlawful conduct; and your submissions do not violate any law or third-party rights.
10. User Content and Uploads
If you submit photos, videos, roof images, documents, comments, chat messages, reviews, testimonials, or other content, you represent that you own or control the right to provide that content and that it does not infringe the rights of others.
You grant Rainbow Roofing a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, store, reproduce, modify, review, publish, display, distribute, and create derivative works from that content for customer service, estimating, scheduling, documentation, legal protection, training, insurance support, operational, evidentiary, and marketing purposes, subject to our Privacy Notice.
We may remove, reject, or preserve user-submitted content at our discretion.
11. Prohibited Uses
You may not: submit false or misleading information; impersonate another person; upload malware or malicious code; attempt to disrupt the site; scrape or harvest data; copy or republish site content without permission; use bots or automated tools to interfere with site operation; use the site for unlawful, defamatory, threatening, abusive, fraudulent, or infringing conduct; or use the site to create liability or harm for Rainbow Roofing.
12. Intellectual Property

To the fullest extent permitted by law, Rainbow Roofing’s total aggregate liability arising from or related to the website or these terms shall not exceed the greater of: (a) the amount you paid directly to Rainbow Roofing solely for use of the website, or (b) $100.00.
15. Indemnification
You agree to defend, indemnify, and hold harmless Rainbow Roofing and its owners, members, managers, officers, employees, agents, affiliates, subcontractors, vendors, successors, and assigns from and against all claims, losses, damages, liabilities, judgments, fines, penalties, settlements, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to: your use of the website, your violation of these terms, your submissions, your false statements, your infringement of another person’s rights, your unlawful conduct, or disputes between you and any third party related to your use of the site.
16. Third-Party Links and Tools
This website may link to or integrate with third-party websites, maps, reviews, analytics tools, CRM tools, financing services, manufacturer pages, payment tools, social media platforms, chat providers, or scheduling systems. Rainbow Roofing does not control and is not responsible for third-party content, performance, availability, or privacy practices.

18. Dispute Resolution; Arbitration; Class Action Waiver
To the fullest extent permitted by law, any claim or dispute arising out of or relating to this website, these terms, communications with Rainbow Roofing, lead submissions, appointment requests, or digital interactions shall first be submitted to Rainbow Roofing in writing for an opportunity to resolve the matter informally.
If not resolved informally, the dispute shall be resolved by binding individual arbitration, except that either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect confidential information, intellectual property, payment rights, non-solicitation obligations, or other urgent rights.
You and Rainbow Roofing agree: arbitration will occur on an individual basis only; no class action, collective action, coordinated proceeding, or representative claim may be brought; no claim may be arbitrated on a class or consolidated basis; and both parties waive any right to jury trial to the fullest extent permitted by law.
If any part of this arbitration provision is found unenforceable as to a specific claim, that claim shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to jurisdiction and venue there.
19. Governing Law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions where applicable.
20. One-Year Limitation Period
To the fullest extent permitted by law, any claim arising out of or related to the website or these terms must be brought within one (1) year after the claim arises, or it is forever barred, unless non-waivable law requires a longer period.
21. Force Majeure
Rainbow Roofing is not liable for delay, interruption, rescheduling, or nonperformance caused by events beyond its reasonable control, including weather, hurricanes, storms, fire, flood, epidemic, labor shortages, supply disruptions, transportation failures, cyber incidents, utility failures, governmental action, civil unrest, or other force majeure events.
22. Reservation of Rights
Rainbow Roofing may investigate suspected violations, remove content, block access, preserve evidence, cooperate with law enforcement, refuse leads, refuse appointments, refuse access, and pursue all legal and equitable remedies available to it.

Rainbow Roofing may modify these terms at any time. Changes become effective when posted unless a later date is stated. Continued use of the website means you accept the updated terms.
